Information on Serving Cell Phone and Social Media Providers

The chart below contains the contact information for the Subpoena Compliance Centers for various cell phone companies and social media networks.

The chart below was originally compiled by the North Carolina Officer of Indigent Defense Services who warns that there is North Carolina authority NC 2010 Formal Ethics Opinion 2 (April 16, 2010) which finds a lawyer may not serve an out of state health care provider with an unenforceable state subpoena and may not use documents produced pursuant to such a subpoena. The same reasoning may apply to service of state subpoenas on other out-of-state offices.

To comply with this ethics opinion, an attorney should consider serving the subpoena on the registered agent or local office capable of accepting service and then sending a courtesy copy of the subpoena to the out-of-state Subpoena Compliance Center. It will probably be helpful to explain to the local office that you are serving them to comply with the Rules of Professional Conduct and are also sending a courtesy copy to the out-of-state Subpoena Compliance Center. The courtesy copy should clearly state that it is a courtesy copy (no legal effect).  Use the Colorado Secretary of State’s searchable database for Registered Agents.
